Convicted mom-killer McGuire files motion seeking a new trial

David Lewis McGuire, who was convicted May 17 on multiple charges in connection with the shooting death of his mother, has filed a motion seeking a new trial. A hearing on the motion is set for Dec. 4 in Lamar superior court before Judge Bill Fears. A Monroe County jury deliberated less than two hours before convicting McGuire of malice murder, felony murder, aggravated assault and three counts possession of a firearm during commission of a felony. The trial was moved to Monroe County due to pre-trial publicity. A trial in Lamar County ended with a hung jury in October 2017. Elaine McGuire was holding a cell phone in her hand attempting to call for help when she was shot six times in her bedroom on Sept. 15, 2016. Two kill shots were fired from close range, according to court testimony. McGuire is serving life without parole and is currently locked away at Hays State Prison.
