The clerk of the December term grand jury that failed to indict former Lamar County payroll clerk, office manager Gretchen Ellerby was the woman who preceded Ellerby in the job. Patty Stephens was elected clerk by her fellow grand jurors. She and her husband also went before a grand jury as part of a comp time dispute and were cleared. Some questioned whether she should have recused herself from the decision on Ellerby but district attorney Richard Milam said there was no conflict because Stephens no longer works for the county.
