At the date and time of the seizure Samuel Henderson was in possession and constructive possession of the said United States currency. Defendant was travelling on Interstate 75 in Lamar County, Georgia, and was stopped for traffic violations by a Deputy with the Lamar County Sheriff’s Office. In plain view in the console area of the vehicle was approximately $800.00 in cash. A consent search of Defendant’s vehicle was conducted, which further yielded an additional large quantity of U.S. currency (approximately $20,000.00) that was located in the back seat inside of a taped up box inside of a suitcase. Defendant had been untruthful with law enforcement, claiming that the currency in the console area was the only money inside the vehicle and further claiming that his only prior criminal conviction had been for a driving under the influence offense when he had, in fact, previous felony and misdemeanor drug offenses. In addition, a money lineup was conducted with the currency in the box, and a trained K9 alerted on the bulk currency obtained from the Defendant’s vehicle. The above-listed property was used or intended for use, directly or indirectly, to facilitate a violation of Georgia’s controlled substance laws in Lamar County, Georgia, punishable by imprisonment for more than one year.
