At the date and time of the seizure Jonathan A. Baker was in possession of the said United States currency. Defendant was travelling on Interstate 75 in Lamar County, Georgia, and was stopped for traffic violations by a Deputy with the Lamar County Sheriff’s Office, at which time the officer smelled the odor of marijuana coming from Defendant’s vehicle. During the course of the traffic stop the officer also determined that the Defendant did not possess a valid driver’s license. A lawful search of the Defendant’s vehicle and person yielded the above-listed, bundled property in addition to a quantity of marijuana. Further, the officer found that Defendant had an active probation violation warrant out of Bibb County, Georgia, for a felony drug offense and had other felony drug distribution convictions. The above-listed property was used or intended for use, directly or indirectly, to facilitate a violation of Georgia’s controlled substance laws in Lamar County, Georgia, punishable by imprisonment for more than one year, and/or said property was found in close proximity to a quantity of methamphetamine. (4-9)(2)(b) Notice of Seizure and Forfeiture State of Georgia vs. Twenty Thousand Six hundred ($20,600.00) dollars in United States currency Case No. 19B-095-W On or about January 22, 2019, on and around Interstate Highway 75 in Lamar County, Georgia, officers of the Lamar County Sheriff’s Office seized the above-listed property. At the date and time of the seizure Samuel Henderson was in possession and constructive possession of the said United States currency. Defendant was travelling on Interstate 75 in Lamar County, Georgia, and was stopped for traffic violations by a Deputy with the Lamar County Sheriff’s Office. In plain view in the console area of the vehicle was approximately $800.00 in cash. A consent search of Defendant’s vehicle was conducted, which further yielded an additional large quantity of U.S. currency (approximately $20,000.00) that was located in the back seat inside of a taped up box inside of a suitcase. Defendant had been untruthful with law enforcement, claiming that the currency in the console area was the only money inside the vehicle and further claiming that his only prior criminal conviction had been for a driving under the influence offense when he had, in fact, previous felony and misdemeanor drug offenses. In addition, a money lineup was conducted with the currency in the box, and a trained K9 alerted on the bulk currency obtained from the Defendant’s vehicle.
