(5-14)(2)(b)Notice of Seizure and ForfeitureState of Georgiavs.Thirteen Thousand Three hundred sixty ($13,360.00) dollars in United States currencyCase No. 19B-143-WOn or about March 4, 2019, on and around Interstate Highway 75 in Lamar County, Georgia, officers of the Lamar County Sheriff’s Office seized the above-listed property. At the date and time of the seizure Torey Washington was in possession and constructive possession of the said United States currency. Defendant, the sole vehicle occupant, was travelling on Interstate 75 in Lamar County, Georgia, and was stopped for traffic violations by a Deputy with the Lamar County Sheriff’s Office. Defendant presented the deputy with a limited work/school permit driver’s license, but was neither going to or coming from a destination authorized by his driving permit. The deputy also smelled the odor of raw marijuana coming from within the vehicle. A search of Defendant’s vehicle was conducted, during which the deputy observed loose pieces of marijuana scattered about the vehicle. The search yielded the above-described property located in a book bag in the front passenger side floorboard. A smaller amount of the described currency was located on Defendant’s person. The said book bag smelled heavily of marijuana and also contained marijuana residue. Defendant gave the deputy conflicting information about his reasons for having and the usage of the money. In addition, Defendant has a long history of felony drug charges. The above-listed property was used or intended for use, directly or indirectly, to facilitate a violation of Georgia’s controlled substance laws in Lamar County, Georgia, punishable by imprisonment for more than one year.
