Wadsworth descendants hit B’ville with lawsuit

Covington attorney John Strauss, on behalf of Cynthia Wadsworth and Mike Ross, has filled suit against the City of Barnesville to halt reloction of graves in the Wadsworth-Clayton Cemetery. City officials were served with the suit Wednesday morning. Strauss, who formerly practiced law in Barnesville and was involved in legal action regarding the same cemetery in 1997, filed the suit in Fulton County Superior Court. In the suit, the family claims Lamar superior court was the proper venue for the issuance of a grave relocation permit and that city employees ‘butchered’ mature trees at the cemetery, desecrating graves in the process. The suit also contends the process used by the city to notify descendants of those buried in the cemtery, which dates back to the early 1800s, was deficient. The suit asks the relocation permit be voided, the court restrain the city from beginning work on the relocation and that the city be sanctioned as the court deems appropriate.
